These Terms of Service (the "Terms") govern access to and use of the tradermade.io platform (the "Platform") operated by TRADERMADE LIMITED, a company incorporated in Hong Kong (the "Company", "we"). By accessing the Platform or creating an account, you accept these Terms in full.
01Purpose
The Platform offers educational content and a community environment in the field of trading: live commented sessions, individual coaching, community of practice, training modules, trading journal.
The Platform is not an investment service. No content published on the Platform constitutes investment advice, a personalised recommendation, an offer or solicitation to buy or sell financial instruments, or a portfolio management service within the meaning of the Securities and Futures Ordinance (Cap. 571) of Hong Kong.
02Acceptance
Access to the Platform and the creation of an account imply full acceptance of these Terms, our privacy policy and our risk disclosure.
The Company reserves the right to modify these Terms at any time. Users will be notified of substantial changes by email or in-app notification. Continued use after notification constitutes acceptance of the updated Terms.
03Eligibility
Use of the Platform is reserved for natural persons of legal age (at least 18 years old in their jurisdiction of residence) with the legal capacity to contract.
Access may be restricted in jurisdictions where the provision of the service would conflict with local laws. It is the user's responsibility to verify the legality of access in their jurisdiction.
04User account
Registration is free. The Company does not charge for basic Platform access and does not require a payment card upon registration. Certain advanced features may, in the future, be subject to separate clearly disclosed pricing.
- The user undertakes to provide accurate information upon registration.
- The user is responsible for the confidentiality of their login credentials.
- Any activity carried out from the account is presumed to be the act of its holder.
- The user may delete their account at any time from the interface, or by request to support@tradermade.io.
05User obligations
The user undertakes to use the Platform in accordance with its purpose and applicable law. In particular, the user shall not:
- Distribute illegal, defamatory, hateful, harassing, or privacy-infringing content.
- Sell, rent, or make their account available to a third party.
- Reuse or redistribute Platform content for commercial purposes without prior written authorisation.
- Engage in mass scraping, automated data extraction, or any operation likely to disrupt the Platform.
- Use the Platform to offer or solicit unauthorised investment services.
- Provide paid "trading signals" to other members through the Platform.
06Intellectual property
All Platform content (videos, articles, training modules, code, design, trademarks, logos) is the exclusive property of the Company or its partners.
The user is granted a personal, non-exclusive, non-transferable and revocable right to access content for private use, within the framework of normal Platform use. Any other use requires prior written authorisation.
User-generated content (community messages, journals, comments) remains the property of its author. By publishing it on the Platform, the user grants the Company a worldwide, royalty-free and non-exclusive licence to host, display and index it, to the extent necessary for service operation.
07Educational nature — No financial advice
Platform content is for strictly educational purposes. It does not constitute personalised investment advice. Any trading decision made by the user is solely their responsibility.
Article 7 — Tradermade Terms
Coaches active on the Platform share their methodology and practice for educational purposes. Their statements are not personalised recommendations and do not take into account the financial situation, investment horizon or risk tolerance of any individual user.
The user acknowledges having reviewed our risk disclosure before using the Platform.
08Limitation of liability
To the maximum extent permitted by applicable law, the Company shall not be liable for:
- Any direct or indirect financial loss suffered by the user in connection with their market operations.
- Any temporary Platform interruption, including for maintenance or force majeure reasons.
- Any indirect damage, loss of opportunity, loss of data, loss of image, or loss of business resulting from Platform use.
- Content published by other users.
The Company's total liability, across all types of claims, shall under no circumstances exceed the amounts actually paid by the user to the Company over the previous twelve (12) months.
09Indemnification
The user agrees to indemnify and hold harmless the Company, its directors and employees, against any claim, action, damage or expense (including reasonable legal fees) arising from a breach by the user of these Terms or any applicable law.
10Suspension and termination
The Company reserves the right to suspend or terminate a user's access, without notice or compensation, in case of breach of these Terms, abusive behaviour, or risk to Platform or member security.
The user may terminate their account at any time, without notice, from the interface or by email to support@tradermade.io.
11Force majeure
Neither party shall be liable for failure to perform its obligations resulting from a force majeure event, as defined by applicable case law, including natural disasters, public authority actions, major network infrastructure failures, or massive cyber attacks.
12Governing law and jurisdiction
These Terms are governed by the laws of the Hong Kong Special Administrative Region (Hong Kong SAR), without regard to its conflict of laws rules.
In case of dispute regarding the interpretation, performance or termination of these Terms, the parties shall endeavour to find an amicable solution. Failing this, the competent courts of Hong Kong shall have exclusive jurisdiction.
